Hot on heels of Zahid's 'MPs topple Najib' plot, talk of no-confidence vote at special UMNO AGM swirl
KUALA LUMPUR - Umno Kluang division chief Jais Sarday says that rumours regarding a motion of no-confidence towards Umno president Datuk Seri Najib Razak are “nonsense”.
He said that although such a move can be made through Umno’s constitution, he believed that a more mature approach should be taken to resolve the matter.
“For me, even if a Special AGM (annual general meeting) is called, it will not help solve the root of the problem because not everyone will agree to it.
“Let us solve this in a mature manner, in my opinion. For now, I see no need to call for a special AGM,” the Mahkota assemblyman said.
He told this to The Rakyat Post in response to questions on the current crisis that is plaguing Umno following the recent Cabinet reshuffle, where Umno deputy president and former Deputy Prime Minister Tan Sri Muhyiddin Yassin was dropped from office.
When commenting on the implementation of a vote of no confidence, Jais, who is also Johor Umno state liaison secretary, said Umno’s constitution does not prohibit its members from doing so in removing the president or the deputy president of the party.
He said the matter was provided for in the party’s constitution under certain clauses.
However, it should be implemented in situations that allow the motion to be raised through a special general assembly.
“According to clause 9.12, Umno Supreme Council members, including the president and deputy president, can be stripped of their title or removed by a special general assembly through clause 8.5 with a vote of no confidence with two-thirds of total members that could attend.
“Under Clause 8.5, the special general assembly has to be held when needed by one of three requests, which are. firstly through request by the presidentand secondly through written request from two-thirds of the Supreme Council members.
“And thirdly, through written request by at least half of the total of all divisions, with the condition that the divisions have held meetings with representative on the same problem.”
Jais said at some level, the party’s constitution also gives power to normal members to call a special general assembly if the secretary-general failed to do so.
“According to clause 8.6, the secretary-general has to call for a special general assembly within 14 days from the last date the request (for a vote of no confidence) was received.
“If the secretary-general fails to do so, after 14 days, the permanent chairman and deputy permanent chairman can call for a special general assembly up till 28 days. That means another two weeks,” said Jais.
According to him, after the 28th day, if both (secretary-general and permanent chairman and deputy chairman) do not call, on the 29th day, one of the divisions that applied to have the assembly can be called for the special assembly with the condition that each division has had a meeting at their division level.
“So with a total of 191 Umno divisions nationwide, there should be at least 96 divisions that call for the same motion,” Jais explained. - Therakyatpost
