If Anwar can prove in his coming appeal that he did not rape Saiful, and that Saiful agreed to have sex with him, and that Saiful actually enjoyed it, and that Muhammad Shafee Abdullah sent Saiful as bait to trap Anwar, then we might see Anwar released from jail after all.

On 24th April 2013, the BBC reported that a woman who agreed to sex might still be the victim of rape. The most senior judge in England and Wales and two other judges said there was consensual penetration, but the man behaved aggressively and ignored the woman’s demand that he not ejaculate.

The argument put forward by the late Karpal Singh is that Anwar was wrongly charged for rape — hence the charge is defective. First of all, Saiful is stronger than Anwar so it would be impossible for a weaker man to rape a stronger man. Secondly, Saiful went to meet Anwar ‘armed’ with KY jelly, which means he went to that apartment prepared for sex.

Karpal’s contention (plus of many others: see below) is that the sex between Anwar and Saiful was consensual and that Anwar should not be charged for rape and that Saiful should be charged alongside Anwar and both be made to face a joint-trial.
