A company was fined RM8,000 by the Kuala Lumpur Magistrate’s Court today for importing and distributing mineral water that contained cancer-causing nitrite.
Albert Wines & Spirits (M) Sdn Bhd finance manager Mum Yew Leong pleaded guilty to the charge.
Magistrate Mohamad Aizat Abdul Rahim also ordered the company to pay the prosecution RM300 for costs and publication in the newspapers of the conviction, pursuant to Section 12 of the Food Act 1983.
According to the facts of the case, the Kepong-based company, as instructed, handed to health officer Norazlina Ayub a sample of the Natural Artesian Water (Fiji) mineral water at 10.50am on April 23, 2019.
The officer analysed and found the sample to contain Nitrite (NO2) at 0.02 mg/l, which is higher than the permitted rate of 0.005 mg/l.
The company was charged under Section 13B(1) read together with 13B (2)(e) of the Food Act 1983 and punishable under Section 13(4) of the same Act which provides for a maximum fine of RM20,000 or five years imprisonment, or both, upon conviction.
Earlier, Selangor Health Department prosecuting officer Jeffry Sani Sahimi urged the court to impose a deterrent sentence.
In mitigation, Mum, who was unrepresented said the company had already taken action to recall the products.
