Sales clerk with obscene videos, pics in his phone fined RM4,500

KANGAR: A sales clerk of a private company was fined RM4,500 by the magistrates’ court here today for possessing obscene photos and videos in his mobile phone last year.

Magistrate Kamaliza Md Zain meted out the sentence to Asyraf Hafizuddin Abdul Jalil, 26, after he pleaded guilty to committing the offence.

The court also ordered the man to serve 12 months in jail if he failed to pay the fine. The man paid the fine.

Asyraf was charged with possessing 80 photos, 163 videos and one electronic file (PDF) that were obscene in nature in his Samsung A50 SM-A505F/DS mobile phone at a house in Taman Jelempok Jaya, Kampung Utan Kandis, Arau, here at 11.30am on March 31, 2021.

The charge was framed under Section 292 of the Penal Code that relates to dealing with the sale, hire, distribution and public exhibition of obscene materials. Those found guilty of the offence can be jailed up to three years, or fined, or both.

Earlier, Asyraf, who was unrepresented, pleaded for a lenient sentence as this was his first offence and he had apologised for his mistake.

However, deputy public prosecutor Fazril Sani Mohamed Fadzil from the Malaysian Communications and Multimedia Commission (MCMC) requested the court to impose a deterrent sentence to serve as a lesson to the accused. - FMT
