KUALA LUMPUR: The High Court here has granted a bid by former intelligence chief Hasanah Ab Hamid for a full acquittal in her RM50 million criminal breach of trust (CBT) case.
In April last year, the High Court granted a discharge not amounting to acquittal (DNAA) against Hasanah over the case.
Today, judicial commissioner Roz Mawar Rozain allowed Hasanah’s application to vary the court order from a DNAA to a full acquittal after the prosecution, represented by deputy public prosecutor Fairuz Johari, did not raise any objection.
“Based on the fact that the prosecution does not desire to pursue (the case further), this court is going to grant an order of discharge and acquittal on the applicant,” Roz Mawar said.
“It is not fair to have (the charge) hanging over her head for more than one year.”
With the order for a full acquittal, the prosecution cannot charge Hasanah with CBT again.
Last year, Kualoa Lumpur High Court judge Ahmad Shahrir Mohd Salleh gave Hasanah the DNAA after the prosecution informed the court that it will not continue the case against her.
Hasanah was accused of misappropriating RM50 million in government funds which she was entrusted with between April 30 and May 9, 2018.
The case was heard from Oct 6, 2020 to April 12 last year, with a total of 10 witnesses testifying.
Hasanah was represented by lawyers Suhaimi Ibrahim, Hamdan Hamzah, Ashraff Mohd Diah and Izwan Ariff Ibrahim.
Recently, law minister Wan Junaidi Tuanku Jaafar told the Dewan Rakyat that investigations against Hasanah were ongoing.
He said the delay was due to the Malaysian Anti-Corruption Commission’s (MACC) concurrent investigation against its own officer over missing case items related to Hasanah’s case. - FMT
