KUALA LUMPUR:
The High Court has fixed June 12 to decide  whether former research assistant Yusoff Rawther will be acquitted or told to enter his defence on charges of drug trafficking and possession of fake pistols.

Justice Jamil Hussin, who is presiding over the trial, has ordered the parties to file their written submissions by May 13.

During today’s proceedings, deputy public prosecutor Sabri Othman told the court the prosecution was wrapping up its case after calling 13 witnesses.

Sabri, who was assisted by Shahrizzat Amadan, said the prosecution was ready to present seven more witnesses should the court order Yusoff to enter his defence.

However, Yusoff’s lawyer, Rafique Rashid Ali, said the defence would only decide its next steps after Jamil’s ruling.

Yusoff is also represented by Gurdial Singh Nijar.

The last prosecution witness, investigation officer Zuhairi Zuhir, told the trial today police discovered a package suspected to contain drugs in Yusoff’s car during an inspection at a car park near a surau located within the Kuala Lumpur police headquarters.

Zuhairi, a narcotics officer with the Dang Wangi police criminal investigation division, said the car was searched for bullets after two fake pistols were seized in a raid outside a condominium at Bukit Kiara.

During an earlier hearing, a police sergeant, Chong Choon Khen, who took part in the raid, said Yusoff was handcuffed after the fake pistols were found in the front passenger seat of the vehicle.

Chong said he escorted Yusoff, who was seated in the back passenger seat, to the Kuala Lumpur police headquarters, with the car being driven by a police officer.

Zuhairi said the raid outside the condominium was conducted after a tip-off about firearms in the accused’s car.

During cross-examination, Rafique questioned Zuhairi about Yusoff’s statement that the drugs and the fake pistols were planted to entrap him.

The police officer agreed with Rafique that Yusoff may not have knowledge of or control over the drugs.

Yusoff is accused of trafficking in 305gm of cannabis found in the vehicle when it was parked in front of the surau at 10.15am on Sept 6, 2024.

The drugs were allegedly wrapped in a black plastic bag.

The charge, framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952, provides for life imprisonment and also whipping of not less than 12 lashes upon conviction.

Yusoff is also charged with possessing two fake pistols outside the Senada Condominium on Jalan Bukit Kiara at 9.25am the same day.

The imitation pistols were allegedly wrapped in a black plastic bag.

The charge, under Section 36(1) of the Arms Act 1960, carries a maximum penalty of one year in prison, a fine of up to RM5,000, or both, upon conviction. - FMT
