Boeing Composites Malaysia denies claims of union-busting

 


Boeing Composites Malaysia Sdn Bhd (BCM) has denied allegations of union-busting at its Bukit Kayu Hitam facility in Kedah.

This follows claims by the National Union of Transport Equipment and Allied Industries Workers (Nuteaiw) that the management pressured staff after a strong pro-union vote.

The company said it is not collecting signatures from workers in support of a judicial review against the results of a secret ballot for the formation of a union.

A company spokesperson told Malaysiakini that the judicial review application was prompted by concerns expressed by employees about the voting process at the secret ballot.

However, the spokesperson did not elaborate on the employees' concerns. Malaysiakini has asked the company to specify the nature of the alleged irregularities.

The High Court will make the final decision, the company said.

‘Company pressured workers’

In a statement recently, Nuteaiw general secretary Gopal Kishnam Nadesan claimed that BCM management had pressured employees to sign a petition to reject the union.

This was despite more than 85 percent of workers voting in favour of the union during the secret ballot held on Dec 10, 2025, he said.

"Malaysia’s Industrial Relations Act 1967 clearly states that the director-general (of industrial relations) is duty-bound to accord recognition once majority support is proven via secret ballot.

"A post-election petition manufactured by the employer has no legal standing and serves only to undermine the democratic process," he added.

Gopal also accused BCM of violating Sections 4 and 5 of the Industrial Relations Act, which prohibit any interference in the establishment of unions.

The company has also violated Article 2 of the International Labour Organization's Right to Organise and Collective Bargaining Convention No. 98, which Malaysia has ratified, he alleged.

Article 2 protects the establishment of workers' organisations from interference.

Due to this, Gopal urged Human Resources Minister R Ramanan to intervene and halt BCM's alleged union-busting activities.

He further called for the government to introduce a "bystander" clause in the Industrial Relations Act to reduce the role of employers to bystanders during a secret ballot.

This would reduce interference during the voting process or protracted disputes through litigation, he explained.

"The Malaysia Madani vision must not be a hollow slogan. It must protect the vulnerable and uphold international labour standards.

"We will not allow our members to be left defenceless against corporate overreach," Gopal asserted.
