Activist claims trial over videos allegedly condemning PM

A political activist investigated for his videos allegedly condemning prime minister Ismail Sabri Yaakob has claimed trial to four charges under the Communications and Multimedia Act (CMA) 1998.

Jufazli Shi Ahmad pleaded not guilty in the Kuala Lumpur Sessions Court today to two charges under Section 233(1) and two charges under Section 249 of the same act before judge Norhasniah Abdul Razak.

Framed under Section 233(3), the charge is for the offence of improper use of network facilities to make an obscene posting with the intent to annoy another person.

If found guilty, the freelance researcher may be fined not exceeding RM50,000, jailed for up to a year, or penalised with both penalties. A further fine of RM1,000 may also be imposed for each day the offence is continued after conviction.

According to a copy of the charge sheet, Jufazli allegedly uploaded a TikTok posting on June 23, and a Youtube posting on June 27 for improper use of network facilities or services.

He had allegedly called out the prime minister in a TikTok video over the recent price hikes and in a Youtube video titled “Panas!!! ‘Supermodel’ Ini Kantoi Merompak RM77.3 Billion!?!?”

During questioning at Dang Wangi district police headquarters at 12.10pm on July 5, Jufazli allegedly failed to provide the password to his Youtube account King Maker Politik to investigating officer Ahmad Faidz Hamdan.

He also allegedly failed to provide the password to his TikTok account ‘@kingmakerofpower’ at 3pm later that day to investigating officer M Jagachandran, resulting in the charges under Section 249.

Punishable under Section 242 of CMA for failure to comply, Jufazli may be liable to a fine not exceeding RM100,000 or imprisonment for up to two years, or both.

The court, in allowing him bail for RM3,500 for each charge - RM14,000 total - with one surety, set Aug 29 for mention.

The prosecution was conducted by DPPs Nadiah Mohd Izhar and Nor Azizah Aling, while lawyer Rajsurian Pillai represented Jufazli.

Jufazli, also the Gerakan Anak Muda Selamatkan Sabah founder, was previously remanded for seven days for allegedly insulting Prime Minister Dr Mahathir Mohamad.

In a 58-minute video, he accused Mahathir of corruption, power abuse and colluding with PAS president Abdul Hadi Awang and Sarawak governor Abdul Taib Mahmud.

He was also reported to have a separate ongoing case in the Sepang Sessions Court under Section 233 of CMA. - Mkini
