PETALING JAYA: A woman who is claiming trial to stealing two packets of Milo valued at RM74 is out on bail after spending time in the lockup, her lawyer said.
Naran Singh said a Good Samaritan yesterday posted RM3,000 in the Marang magistrates’ court for Suhaini Mohd to be freed from the Pengkalan Chepa prison near Kota Bharu.
“She left the prison yesterday evening to be reunited with her family,” the lawyer told FMT.
On July 5, the Marang magistrates’ court sentenced her to 14 months’ jail after she pleaded guilty to theft.
However, on July 19, Kuala Terengganu High Court judge Hassan Abdul Ghani ordered a retrial after setting aside Suhaini’s conviction and 14 months’ jail term.
The judge, who had called up the case on his own volition after it grabbed public attention, agreed with Naran that fair trial procedures were not followed when she pleaded guilty.
The mother of four was then represented by a lawyer from the National Legal Aid Foundation.
The 43-old-woman was produced before magistrate Engku Nurul Ain Engku Muda later in the afternoon, after the High Court proceeding, and charged again with committing the offence at a local supermarket in Marang on May 25.
This time, she claimed trial and was allowed bail at RM3,000.
Suhaini was taken back to the Pengkalan Chepa prison as proceedings lasted until late evening and the case was fixed for mention on Sept 6.
The theft was caught on the supermarket’s security camera and the owner tailed her in an attempt to catch her. In her haste to flee, she left her motorbike behind at the Marang bus station.
Suhaini was detained at her home in Kampung Baru Kuala Abang, Dungun, after authorities tracked her down using the motorcycle’s registration number.
Her case had also caught the attention of former health minister Dzulkefly Ahmad, who urged the Attorney-General’s Chambers to show mercy.
Dzulkefly said he was exasperated by what he deemed to be “a decision barren of the concept of proportionality and reasonableness”. - FMT
