Sundra withdraws suit against ex-AG Thomas, govt

 


Former Asian International Arbitration Centre (AIAC) director Sundra Rajoo has retracted his wrongful prosecution suit against former attorney-general Tommy Thomas and the government.

The plaintiff’s legal team from firm Messrs Cheok Ng Lee Law Chambers filed the notice of discontinuance at the Kuala Lumpur High Court on March 8.

According to a copy of the filing made available to the media today, it not only bore the signature of Sundra’s lawyer but also the signature of defendant Thomas’ legal team from Messrs Tommy Thomas.

The notice of discontinuance also bore the signatures of the attorney-general on behalf of the other 12 defendants.

The withdrawal of the legal action followed on the heels of a settlement reached between Sundra and the government, on which the terms of the settlement are confidential.

Immunity from arrest

On Oct 15, 2021, Sundra filed the lawsuit against Thomas, the government, MACC, and 10 other defendants, alleging that he suffered false imprisonment and malicious prosecution, among other allegations.

As far back as March 11, 2019, Sundra (above) had gone to the High Court in Kuala Lumpur (via judicial review) to uphold his immunity from arrest and prosecution for alleged offences committed while in office.

Over two weeks later, on March 26, he was again hauled up before the Sessions Court in Kuala Lumpur, where he claimed trial to three charges of CBT involving RM1,011,367.50.

Thomas was at the time the AG under the Pakatan Harapan administration.

However, in April 2021, the Federal Court ruled that Sundra enjoyed immunity over alleged acts committed during his tenure as AIAC director.

Back as AIAC director

Meanwhile, when contacted by Malaysiakini this afternoon, a representative from AIAC revealed that Sundra is set to return to the centre as its director next week.

The representative said that Sundra's new tenure as AIAC director will begin this coming Monday.

The media previously reported that he stepped down as AIAC director on Nov 21 2018. - Mkini
