Decision on govt’s bid to stay 40% revenue share order on Monday

 The Court of Appeal today concluded hearing the federal government's application for a stay order over Sabah’s 40% share of net federal revenue.

The federal government filed an application with the Court of Appeal on March 3 to stay the High Court’s order.

 The Court of Appeal has fixed April 6 to deliver its decision on Putrajaya’s application to stay the execution of a High Court order on Sabah’s entitlement to a 40% share of net federal revenue derived from the state.

Sabah Law Society president Nazim Maduarin said the appellate court concluded hearing the federal government’s application for the stay today.

“The panel has fixed April 6 for delivery of its decision.

“The application concerns whether the High Court’s orders, including the timelines set by the court, are to remain in force pending the disposal of the appeal,” he said in a statement.

On Oct 17, the Kota Kinabalu High Court ruled that the federal government had acted unlawfully by failing to honour Sabah’s 40% share of net federal revenue derived from the state for nearly five decades.

The court directed the federal government to conduct a review with Sabah to determine the quantum of the state’s entitlement for each financial year from 1974 to 2021.

It also ruled that the review must commence within 90 days of the delivery of the judgment and be completed within 180 days, or by April 15.

The federal government filed an application on March 3 to stay the High Court’s order, while the Sabah government had moved to oppose the application. - FMT
