Premier Najib Abdul Razak and his wife Rosmah Mansor will not be testifying in the sodomy II trial.
This follows the Kuala Lumpur High Court's ruling today in which the subpoena served on them to testify as defence witnesses in the Anwar Ibrahim trial was struck out by Justice Mohamad Zabidin Mohd Diah.
In allowing Najib and Rosmah"s application to be set aside, Mohamad Zabidin said they are not relevant and material witnesses in the trial.
"Hence I allow the applications and order the trial to continue," he said.
Najib and Rosmah was represented by lawyers Ghazi Ishak, who is the third Prime minister Hussein Onn's son-in law, Hisyam Teh Poh Teik, Salehuddin Saidin, M Athimulan and Affifuddin Mohd Afifi.
The defence had tried to interview Najib and Rosmah in August, but both had refused to be defence witnesses and said they would only come to court if subpoenaed.
However, since the subpoenaes had already been issued, they chose to apply to set it aside.
