Court final arbiter on suit against Ambiga, says Nazri
Only the court can decide if the suit filed by the Malaysian government against Bersih 3.0 chairman S Ambiga and her nine committee members, has legal basis or not, said Minister in the Prime Minister's Department Mohamed Nazri Abdul Aziz.
He said this when asked to comment on the statement by the opposition in a news portal that the suit did not have legal basisand should be withdrawn.
"This country has a legal system that allows any quarter to file a suit if an offence has been committed against them," he told reporters after launching a rafting expedition on Sungai Perak in conjunction with Visit Perak Year 2012, in Kuala Kangsar today.
Recently, the government filed a suit against Ambiga, Maria Chin Abdullah, Zaid Kamarudin, Haris Fathillah Mohamed, K. Arumugam, S Arul Prakkash, Wong Chin Huat, Dr Ahmad Farouk Musa, Toh Kin Woon and Andrew Khoo for failing to control the April 28 rally which resulted in damage to public property.
The government is seeking a special compensation of RM122,000 for the repair of police vehicles, interest and other costs and relief deemed fit by the court.
Meanwhile, when asked about ex-solicitor general II Mohamed Yusof Zainal Abiden becoming a counsel for Opposition Leader Anwar Ibrahim's counsel in a case related to the April 28 rally, Mohamed Nazri said Yusof was free to represent anybody in court as he was now a legal practitioner.
"Yusof resigned in February. I understand Anwar called him (Yusof) purportedly to strengthen his case (Anwar) in his defence but it is the judge who decides whether a person is guilty or not, not his own counsel," he said.
