Malacca City Council sues state MCA Wanita chief


The Sessions Court in Malacca today set Aug 15 for mention of a suit filed by Historic Melaka City Council (MBMB) against Malacca MCA Wanita chief Kian Sit Har over losses incurred by the council during the Bersih 3.0 rally at Dataran Pahlawan Megamall in Malacca last April 28.

Judge Abu Bakar Katar set the date following Kian’s request for time to appoint a lawyer and to file her defence statement.

NONEMBMB, represented by the legal firm of Messrs Muhammad Jailani & Partners, also informed the court that it had yet to serve the summons on five others named in the suit.

They are  Khoo Poay Tiong, Philip Chua, Yuhaizad Abdullah, Halim Bachik and Abd Ghani Abd Rahman.

Kian was named the sixth defendant in the suit.

In the suit filed on May 4, MBMB claimed that the defendants were the organisers or participants or supporters or the persons responsible or who gave orders or stirred anger in the illegal assembly which resulted in the council to suffer losses due to damage to property and public facilities under its administration.

The council also claimed that the defendants had entered and gathered at the entrance of Dataran Pahlawan with the intention of creating mischief and to disrupt public order.

It said the defendants failed to heed orders by the authorities to disperse, resulting in eight enforcement personnel to be injured in the incident.

MBMB is seeking exemplary, general and special damages, cost and other relief which the court deems fit.
