The Kuala Lumpur High Court will decide on Friday if the DAP re-election of its central executive council this Sunday can be held.
This was after the court heard submissions to strike out a suit by a former DAP member who claimed that the party's re-election was unconstitutional.
DAP secretary-general Lim Guan Eng filed the application to strike out a suit brought by former Ladang Paroi DAP branch vice-chairman A. David Dass, who claimed that members were not given the required 10-week notification prior to the re-election.
Dass had filed the suit on September 10 claiming the re-election this Sunday was against the party's constitution. He also applied for an injunction to stop the DAP from holding the re-election.
Judge Datuk Rosnaini Saub fixed Friday for her decision after hearing submissions from parties today.
