IGP tries to ducks Seremban kidnap issue BUT draws more fire by refusing to RESPECT HIGH COURT RULING
The Inspector-General of Police today said that his men are probing all reports lodged by a clerk against her ex-husband but will not act on their child custody tussle.
Tan Sri Khalid Abu Bakar said police have opened four investigation papers based on S. Deepa's reports, including allegations that Izwan Abdullah had assaulted her and that he had violated an interim protection order.
The protection order under the Domestic Violence Act was issued last August.
"We will not interfere in the child custody issue, but for the rest we will do our job," he told journalists when met in Kuala Lumpur today.
Khalid said police had in the past arrested Izwan but released him on bail pending completion of investigations.
Izwan and Deepa have obtained custody of their two children through the Shariah Court and the High Court, respectively.
Khalid had used this as an excuse not to act against Izwan last week, despite the Muslim convert's actions in "kidnapping" his son, and causing harm to Deepa in the process, on Wednesday, just two days after she won full custody of her two children in the Seremban High Court.
Khalid claimed that no action would be taken against Izwan even though the High Court had ruled in favour of Deepa.
He said the Shariah Court last year gave custody to Izwan and nothing untoward occurred when the children was with the father.
Khalid said the reports made by Deepa against Izwan were related to domestic disputes that could be referred to a magistrate.
"There is domestic violence report and another for causing hurt under section 324 of the Penal Code," he said.
Khalid said police had in the past arrested Izwan but he was freed on bail but investigation proceeded.
Current Culture and Tourism Minister Datuk Seri Mohamed Nazri Abdul Aziz last Saturday described the case a clear cut kidnapping.
“The High Court judge’s ruling was correct. The police shouldn’t allow him to get away with kidnapping the child,” said Nazri who was also a former de facto law minister.
The Cabinet in April 2009 announced that children be raised in the common religion at the time of marriage should one of their parents convert.
It had also declared a ban on parents secretly converting their children, and had stated that outstanding issues in a marriage should be settled before conversion to prevent victimising the children.
Former law minister Datuk Zaid Ibrahim also criticised the police.
Deepa was given custody of her two children by the High Court in Seremban on April 7.
A Shariah Court had earlier given custody of the children to Izwan, a lorry driver who embraced Islam last year.
Izwan later said he took his son fearing his ex-wife would convert their children back as Hindus. - TMI
