Khir Toyo appeal postponed yet again


Former Selangor menteri besar Dr Mohd Khir Toyo's final appeal against a corruption conviction, scheduled for today at the Federal Court, has been postponed indefinitely.

His lawyer Muhammad Shafee Abdullah (right) is in Japan to represent Malaysia at a four-day conference organised by the Asean Inter-governmental Commission for Human Rights.

Federal Court corporate communications head Mohd Aizuddin Zolkeply said the registrar had received the application for postponement on April 10.

"As he said that he is representing Malaysia, the court allowed the postponement last week," he said.

This is the second postponement. The hearing was initially slotted in for Feb 6 but was moved to today because of incompatibilityat the Federal Court, where two separate panels were in session.

In both instances, the case was not removed from the court list.



Khir was convicted by the Shah Alam High Court in 2011 of corruptly obtaining two plots of land for himself and his wife Zaharah Kechik, as well as a bungalow, while in public office. The house and land are at No 8 & 10, Jalan Suasa 7/1L, in Shah Alam.

He was found to have obtained the properties from Ditamas Sdn Bhd director Shamsuddin Hayroni, at RM3.5 million, lower than the RM6.5 million paid in 2004.

The court imposed a 12-month jail sentence as well as the seizure of the property. The Court of Appeal upheld the decision last May but granted a stay of execution pending appeal to the Federal Court.
