High Court to hear suit by P.I Bala’s widow

The widow, A. Santamil Selvi, is seeking compensation for losses incurred by the family and their suffering during years in exile.
samtamil_najib_rosmah_law_600PUTRAJAYA: The Court of Appeal on Friday reinstated a RM2 million civil suit by the widow of the late P. Balasubramaniam (or PI Bala) who fled to India with his family in 2008, apparently virtually forced into exile for five years, for their connection with the Altantuya Shaariibuu tragedy.
The widow, A. Santamil Selvi, is seeking compensation for losses incurred by the family and their suffering during years in exile. Bala died of a heart attack shortly after he returned from India with his family.
Carpet trader Deepak Jaikishan, who is saddled with the suit, did not contest the matter.
Justice Vernon Ong Lam Kiat, who headed a three-member Panel, ordered that the suit be sent back to the High Court of in Kuala Lumpur where case management has been fixed for October 23.
Santamil’s lawyer Americk Sidhu told the media outside the Court that the hearing in the High Court will only be against Deepak.
The widow’s original suit was against several individuals including Prime Minister Najib Abdul Razak, his wife Rosmah Mansor, Najib’s brothers Johari and Nazim, lawyer Cecil Abraham, his son Sunil, Commissioner of Oaths Zainal Abidin Muhayat and lawyer M. Arulampalam.
High Court Judge Hasnah Mohamed Hashim allowed the respondents to strike out the suit last December.
Briefly, the civil suit seeks an explanation for Bala’s decision to replace his original Statutory Declaration (SD) with another one the next day making an about turn. In the first SD, Bala alleged that Najib was involved in the Altantuya killing.
Deepak was not a respondent in Santamil’s application to challenge the High Court decision in the Court of Appeal.
