SHAH ALAM: The High Court here has granted bail to Sungai Besar Umno division chief Jamal Md Yunos for the criminal charges against him despite an earlier refusal by the lower courts.
Justice Yazid Mustafa set bail at a total of RM20,000 on two charges of trespassing and another charge of escaping from police custody.
He also ordered Jamal to have three different bailors for the cases.
“It is clear that these are bailable offences and the court finds the magistrates had no jurisdiction to revoke bail or refuse to grant bail,” he said in his brief judgment.
Earlier this month, the Ampang Magistrate’s Court denied bail to Jamal after he pleaded not guilty to escaping from police custody on May 25 at a private hospital here while in the process of completing his bail for several criminal charges he was facing.
He had been in police custody since July 5 after he was escorted back from Indonesia.
Yesterday, the court also withdrew his bail for another two charges for allegedly trespassing on two shop houses.
Earlier today, his lawyer Shafee Abdullah urged the court to grant bail to Jamal on the grounds that the criminal charges he was facing were bailable offences.
He said the lower courts had erred in denying Jamal bail as they did not have jurisdiction to make the order.
“He (Jamal) has been in remand for 27 days without valid reasons,” Shafee said.
Meanwhile, deputy public prosecutor Fairuz Johari said the lower courts found Jamal to be a flight risk, citing that he escaped from police custody and went to Indonesia while in the process of completing his bail provisions.
“Bail was given for his two trespassing cases under Section 448 of the Penal Code but he breached the bail condition by running away,” he said.
Speaking briefly after posting bail at the High Court registry, Jamal said he was thankful for the support from his family and people from Sungai Besar.
“I also want to apologise to those I had caused trouble to,” he said, adding he would hold a press conference soon. - FMT
