Police have opened an investigation paper against DAP secretary-general Lim Guan Eng over a statement issued by Pakatan Harapan on the emergency declaration last month.
Lawyer RSN Rayer said the police contacted Lim yesterday to inform him of the investigation.
"The police are investigating him for a media statement issued by Harapan presidential council on Jan 12," Rayer said in a statement today.
Rayer said Lim was initially summoned by the police to give his statement at the Timur Laut district police headquarters in Penang tomorrow.
"But this has been rescheduled to another date which is yet to be confirmed," he told Malaysiakini.
In a joint statement issued on Jan 12, Lim together with PKR president Anwar Ibrahim and Amanah president Mohamad Sabu disagreed with the government's decision to proclaim a nationwide emergency.
The Harapan leaders urged Prime Minister Muhyiddin Yassin not to hide behind Covid-19 and burden the rakyat with a nationwide emergency proclamation when he has lost the majority support in the Dewan Rakyat.
"We are of the view that Muhyiddin's action to propose an emergency when he has lost the support of the majority of MPs, including from Machang and Padang Rengas, is not acceptable at all.
"Do not hide behind Covid-19 and burden the people with a declaration of emergency for the sake of saving yourself," the Harapan leaders said last month.
It is not immediately known if Anwar and Mohamad are being probed by the police as well.
Taking to social media, Lim said this is yet another effort to silent the voices of the opposition.
Last month, Lim was summoned by the police to record statement for two press releases he issued in 2019.
On Dec 22 last year, Lim decried having been called for questioning on Christmas Eve, claiming that it was a “Christmas gift” from the Perikatan Nasional government and amounted to political persecution.
The next day, Lim said the inspector-general of police had contacted him personally to apologise for the oversight and postponed the questioning.
Beside Lim, other DAP lawmakers - Klang MP Charles Santiago and Perak opposition leader Abdul Aziz Bari - were being probed recently over their remarks.
Two investigation papers were opened against Charles after he commented a court's contempt verdict against Malaysiakini last week and over his speech made at a forum held in 2019 respectively.
The forum was held after police arrested 12 individuals purportedly linked to Liberation Tigers of Tamil Eelam (LTTE) terrorist group under the Security Offences (Special Measures) Act (Sosma). - Mkini
