A total of 11 senior and lower-ranking police officers are facing disciplinary action in relation to the rape incident of a 16-year-old girl at the Miri central police station lock-up.
Bukit Aman Integrity and Standard Compliance Department (Jips) director Zamri Yahya said the officers found to be negligent in carrying out their duties will either be demoted or terminated from their positions.
"Jips has conducted a disciplinary probe to look into elements of negligence and misconduct in the incident.
"Aside from criminal charges against the two officers, 11 other senior and lower-ranking officers found to have failed or are negligent in their duties will also face action (either a demotion or termination)," he said.
The victim claimed, in her police report, that the cell of the male lock-up was not locked.
She alleged the accused unlocked her cell door in the early hours of Jan 9 and proceeded to rape her in the lock-up's toilet.
The 19-year-old suspect pleaded guilty on Jan 12, before changing his plea last week.
On Feb 8, two officers on duty guarding the lock-up - Brase Omang, 55, and Edmund Jali, 44, - were charged under Section 31(1)(a) of the Children's Act 2001.
This section makes it an offence for any person to allow a child under their care to be exposed to abuse. The law provides for a fine of up to RM50,000, up to 20 years imprisonment, or both.
They pleaded not guilty and were granted an undeposited bail of RM10,000 with one local surety each.
The duo also faces an alternative charge under Section 166 of the Penal Code, which states that public servants convicted of causing injury to any person due to disobeying directions of laws could be jailed up to one year, fined, or both. - Mkini
