Military vets get leave in legal challenge over registering party

 


The Kuala Lumpur High Court is set to hear the merits of a legal bid by military veterans to compel the Home Ministry to decide on their application to register their political party.

Judge Ahmad Kamal Md Shahid this morning granted leave to the founders of Parti Kemakmuran Negara to proceed with its judicial review.

In effect, this means that the court will later set a separate date to hear the merits of the legal action over the Home Ministry’s alleged delay in making a decision on the party’s registration application.

In a media statement today, the group’s lawyer Lim Wei Jiet confirmed the outcome of the proceedings.

“The court has fixed further case management on July 27,” the lawyer said.

The party founders come from the Malaysian Armed Forces, the Royal Malaysian Navy, and the Royal Malaysian Air Force.

On May 4 last year, Bernama reported that the veterans voiced their intention to contest the 15th general election (GE15) using their own political platform, targeting about 50 parliamentary and state seats.

MAF Veterans’ Association president Sharuddin Omar (above) said they were in the midst of forming Parti Kemakmuran Negara.

He said they wanted to contest GE15 due to the government’s delay in resolving issues related to veterans, especially salary and pensions, as well as other issues concerning the people.

He claimed they submitted their registration application to the Registrar of Societies (RoS) on March 9.

However, they claimed the RoS - which is under the Home Ministry - rejected their application on March 16.

They alleged they then appealed to the home minister on March 25 to reverse the RoS’ refusal to register Parti Kemakmuran Negara.

The veterans, however, claimed 113 days passed with no decision yet to be made by the minister over the appeal.

Through the legal action filed earlier this month, the party founders claimed such a delay is unreasonable, unlawful, and an infringement on the fundamental right to form associations under the Federal Constitution. - Mkini
