PETALING JAYA: A woman has claimed trial in the Marang magistrates’ court after she was charged again with stealing two packets of Milo valued at RM74.
Suhaini Mohd, 43, is alleged to have committed the offence at a local supermarket in Marang on May 25.
The mother of four, who was produced before magistrate Engku Nurul Ain Engku Muda this evening, was allowed bail at RM3,000.
The case has been fixed for mention on Sept 6.
Her lawyer Naran Singh said Suhaini had been taken to the Pengkalan Chepa prison as proceedings lasted until late evening.
“We are making arrangements for her to raise the bail money,” he told FMT.
However, the lawyer hoped the attorney-general would drop the charge against Suhaini.
Earlier in the day, Kuala Terengganu High Court judge Hassan Abdul Ghani ordered a retrial after setting aside her conviction and 14 months’ jail term.
The judge had called up the case on his own volition after it grabbed public attention.
Naran submitted that the prosecution only tendered a police computer print out showing Suhaini had previous convictions.
“That print out is invalid. The prosecution should have tendered a certificate from the Bukit Aman registrar of criminal records,” he said.
Naran said the prosecution also tendered another four packets of Milo and two packets of Nescafe as exhibits but they had no relevance to the charge she was facing.
“This had prejudiced the mind of the magistrate in imposing a harsh sentence,” he said.
He said no explanation was given to his client on the maximum and minimum sentence for theft when the charge was read to her.
On July 5, the same magistrate (Engku Nurul Ain) sentenced her to 14 months’ jail after she pleaded guilty to theft.
The theft was caught on the supermarket’s security camera and the owner tailed her in an attempt to catch her. In her haste to flee, the suspect left her motorbike behind at the Marang bus station.
Suhaini was detained at her home in Kampung Baru Kuala Abang, Dungun, on June 6 after authorities tracked her down using the motorcycle’s registration number.
Her case had also caught the attention of former health minister Dzulkefly Ahmad, who urged the Attorney-General’s Chambers to show her mercy.
Dzulkefly said he was exasperated by what he deemed to be “a decision barren of the concept of proportionality and reasonableness”. - FMT
