PPSMI is unconstitutional, says law expert

Constitutional expert Abdul Aziz Bari says the DAP is wrong in advocating for an optional continuation of the Teaching of Mathematics and Science in English (PPSMI) as it is unconstitutional.

NONE“(It is) for the simple reason that under Article 152 (of the federal constitution), PPSMI is unconstitutional as official business must be conducted in Malay as the national language.”

This, he said, had always been the case until former prime minister Dr Mahathir Mohamad singlehandedly changed the policy.

Noting that the Kuala Lumpur High Court had in 2010 ruled that PPSMI did not contravene Article 152 of the federal constitution, Aziz said the court was wrong in its decision.

“Under the constitution, it is okay to learn other languages; in fact, public funds can be used for it. But why make the teaching of Maths and Science the guinea pig?”

Even though Pakatan Rakyat’s common policy framework did not elaborate on PPSMI, he said, its general commitment to protect and uphold the major provisions in the constitution, including the Malay language as the national language, was clear.

“DAP, and likewise the MCA, need to be consistent on matters involving the constitution,” Aziz added.
