Hence any good and true Muslim would not waver in the face of a mere jail sentence. Muslims of days gone by were tortured to death and they never wavered or changed their stance. Should you fear a jail sentence when Muslims are supposed to not fear death?

Muslim father defies High Court order to hand over child to ex-wife
(The Malaysian Insider) – Muslim convert Muhammad Ridzuan Abdullah has failed to honour a High Court order to return his infant daughter to his Hindu ex-wife as the noon deadline ended.
Kindergarten teacher M. Indira Gandhi waited eagerly at her lawyer’s office in Ipoh, hoping Ridzuan would turn up with Prasana Diksa.
“We will now proceed to do what is required under the law,” her counsel M. Kulasegaran told The Malaysian Insider.
On May 30, judge Lee Swee Seng found Ridzuan guilty of contempt and gave him until noon today to hand over his daughter to Indira Gandhi or face imprisonment.

Return Deepa’s boy, PM’s Dept tells cops
(Free Malaysia Today) – The Prime Minister’s Department has urged the police to ensure the return of S Deepa’s abducted son to her home.
Referring to a court decision sanctioning force in taking away the 6-year-old boy from his Muslim father, Minister in the PM’s Department Nancy Shukri told reporters today police should take whatever action would be necessary to reunite the child with his Hindu mother.
“From what I’ve read in the media, Deepa’s ex-husband, who had converted to the Muslim religion, took their son with him after the Seremban High Court had given custody to the mother,” she said.
“The police should take the son away from the father and return him to the mother as the courts have been fair in their verdict.”

This is a most interesting case. A Muslim father refuses to hand over his daughter to his Hindu ex-wife although ordered to do so by a non-Muslim judge presiding in a secular court.
Is this Muslim right in his actions?
I suppose if you go by the laws of Moses or Mosaic laws, which is where most Islamic laws come from anyway, then this Muslim is doing the right thing because the Bible clearly says one must not have any pity on even one’s close family members who defy God.
So we have two sets of laws here. One set of laws is divine laws or God’s laws and the other are man-made secular laws. And, as a Muslim, or even as a member of one of the Abrahamic faiths, which laws are you compelled to follow?
An orthodox Muslim would argue that a Muslim father is right in not handing over his children to his non-Muslim ex-wife because then the children would definitely be brought up as non-Muslims. And it is the duty of a Muslim father to ensure that his children are brought up as Muslims.
Hence the secular court’s judgement ruled by a non-Muslim judge should be defied even if the result would be you would be charged with contempt of court and jailed for that ‘secular’ crime.
Were not the Christians for the first 300 years of Christianity told to abandon their faith or else suffer death? And most chose death because God’s laws were supreme and above Roman laws. So what is a jail term for contempt of court when you are supposed to suffer death in defending God’s laws?

This is the dilemma that the Government of Malaysia is now going to face. If this Muslim is arrested and jailed for refusing to allow his daughter to be brought up as a non-Muslim then the entire Muslim community is supposed to rise up in his defence. This was what happened in Singapore in 1950 that resulted in 18 deaths and 173 people injured.
The concept of jihad has been very clearly defined. Jihad is allowed in defence of one’s religious faith. Jihad is not an act of aggression (as some Muslims may believe). Jihad is an act of defence against oppression and injustice. And when a Muslim father is ordered to hand over his daughter to be brought up as a non-Muslim then this is when jihad would apply.
I wait with bated breath to see what Prime Minister Najib Tun Razak is going to do.
In the second case, the Minister in the Prime Minister’s Department ordered the police to intervene and ensure that the son is returned to the Hindu mother. Would the police do this and what would be the reaction of the Muslims if this happens?
The ‘Muslim’ opposition leader and the Islamic party, PAS, have maintained a deafening silence on these two matters. Of course, as politicians who want votes from both sides, they would be hard-pressed to say anything.
If they say the secular court is correct then they would be admitting that God’s laws should not apply. Why then scream and foam at the mouth to insist that Hudud be implemented in Malaysia? If they say ‘defy the secular court because Islam is supreme’ then they would not be respecting rule of law, a ‘crime’ that they accuse the government of.
Not easy being a politician in a country where Islam is the religion of the federation and yet Malaysia is neither a secular country nor an Islamic country, is it?
And, as I said four years ago in 2010, these are amongst the issues that the opposition or the opposition leader have not addressed and the reason why I criticised the opposition because, unlike the common cold, you cannot ignore this and hope it will go away.
So when are we going to address this matter? After the bloodshed starts and Malaysians are slaughtered on the streets by the scores?
