SHAH ALAM - Should Barisan Nasional (BN) adopt PAS’s Syariah Criminal Code (II) (1993) 2015 Enactment as their own, the 58-year-old coalition will break up.
In stating so, PKR legal bureau chief Sivarasa Rasiah also described Gerakan’s injunction filed in Kota Baru on Thursday on the enactment as a “legal joke”.
“These are just political posturing.
“To pass the enactment, firstly, there has to be a majority. And if there is a majority, in order to pass it, BN has to adopt it as its own Bill. If this happens, the coalition will break up,” the Subang Member of Parliament said when met by reporters during a forum titled “11th Malaysia Plan — Inequality in Malaysia” here today.
Adding that the enactment is against the Federal Constitution, Sivarasa said the ball was now in Prime Minister Datuk Seri Najib Razak’s court to make a stand.
However, he explained that the debate on the enactment was totally academic.
“It has been boiled up for nothing. The Kelantan Bill is a ‘dead letter law’ which will never be and can never be enforced.”
The lawyer also wondered why Gerakan filed an injunction on Thursday when the law had yet to be passed.
“Any lawyer with basic skills in mitigation will not do that.
“The enactment is not even a law yet, so why file an injunction? Legally, this is a joke as the challenge is premature.”
Yesterday, Gerakan president Datuk Mah Siew Keong said the application had been submitted to the Kota Baru High Court on Thursday after learning that the enactment was against the Federal Constitution. - http://www.therakyatpost.com/
