EC's stay application on Nurul Izzah's challenge dismissed



The High Court in Kuala Lumpur today dismissed an application by the Election Commission (EC) for a stay of hearing into the merits of Lembah Pantai MP Nurul Izzah Anwar and the voters' challenge on the redelineation exercise.
Justice Azizul Azmi Adnan refused to grant the stay as there were no special circumstances to do so.
He made the decision in chambers after hearing submissions from senior federal counsel Suzana Atan from the Attorney-General's Chambers who represented the EC, and A Surendra and Aliff Benjamin representing Nurul Izzah and the voters.

As a result of this, the court fixed the hearing of Nurul Izzah and the voters' application on Feb 15.
However, this may depend on the outcome of the EC's appeal at the Court of Appeal over Justice Azizul's decision to grant leave (permission) to hear the case on its merits.
Nurul Izzah had last week questioned the hastiness of the appellate court to fix the EC's appeal when the record of appeal has yet to be received.
Justice Azizul granted leave to Nurul Izzah and Anwar's application on Jan 3.
