Rosmah Mansor, the wife of former premier Najib Abdul Razak, is seeking strike out the RM60 million lawsuit filed by Beirut-based jeweller Global Royalty Trading SAL over 44 pieces of jewellery sent to her in February and later seized by the police.
In the defence filed by Geethan Ram, one of Rosmah's lawyers, she describes the suit filed by the jeweller as unlawful, frivolous, vexatious, and an abuse of the court process.
"The company takes the position that our client is liable to indemnify them monies in the sum of RM59.831 million, which is misconceived and without any legal basis.
"The suit filed by Global Royalty contravenes the provisions of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001," the statement of defence read.
In the suit filed on June 26, Global Royalty sought declaration from the court that it is the rightful owner of the 44 items of jewellery – each costing between US$124,000 and US$925,000.
The jeweller claimed that as in previous years, a consignment of jewellery was sent Rosmah according to her demand for her to evaluate and purchase, and to be paid by her or by a third party.
The jewellery was among the haul from raids on two condominium units linked to Najib in the upmarket Pavilion Residences in Kuala Lumpur, in relation to the investigation on funds the former prime minister is said to have received from SRC International.
The company wants the items returned or Rosmah to pay a compensation based on the value of the jewellery.
The former premier's wife maintains that she did not purchase any of the jewellery sent to her for viewing.
"Hence, the legal titles in respect of the jewelleries were never passed to our client.
"The jewellery in question was delivered for viewing by virtue that she was the the wife of the (former) prime minister of Malaysia on the plaintiff's (company) own accord and volition and without there being any obligation to purchase the jewelleries," her lawyer said.
Today is the last day for Rosmah to file her defence.
Besides Geethan, Rosmah is also represented by lawyers K Kumaraendran, Rajivan Nambiar, Reza Rahim, Lavania Raja and Revin Kumar. - Mkini
