Federal Court to hear Sabah rep’s bid for interim stay of Sabah polls

The Federal Court is set to hear an application by a Sabah state representative for a temporary stay of the upcoming Sabah state elections.
Counsel Firoz Hussein Ahmad Jamaluddin today confirmed that Tamparuli assemblyperson Jahid @ Noordin Jahim recently filed the Notice of Motion and that the apex court fixed tomorrow to hear the application.
“The application was filed to seek a temporary stay of the Sabah polls pending disposal of the ‘rightful Sabah chief minister’ appeal by Musa Aman,” the counsel said when contacted this afternoon.
The Notice of Motion named Sabah Chief Minister Shafie Apdal, Sabah state speaker Syed Abas Syed Ali, and the state legislature’s secretary Bernard J Dalinting as respondents.
On Aug 26, Musa was granted leave by the Federal Court to proceed with his appeal to be declared the rightful chief minister in 2018.
On that day, the apex court had also granted leave to Jahid to commence with a similar appeal.
According to a copy of the Notice of Motion, Jahid seeks a proclamation that the announcement by the Sabah governor on July 30 for the dissolution of the 15th Sabah state legislature to stay until disposal of the appeal at the Federal Court.
He seeks an order “that any notices and/or writ of the election of any of the constituencies in Sabah issued by the Election Commission following the proclamation to stay until the disposal of the appeal herein”.
Jahid also seeks an order that “the Election Commission be refrained from acting on, carrying out, or otherwise taking any steps to give effect to, any notices and/or writ of election for any of the state constituencies in Sabah issued by the Election Commission following the proclamation until disposal of the appeal herein,” the cause paper stated.
Checks on the online cause list at ecourtservices.kehakiman.gov.my showed the matter is listed for hearing before the Federal Court in Putrajaya at 9am tomorrow.
The Election Commission had set the Sabah polls for Sept 26, with the nomination set for this Saturday. - Mkini
