The Attorney-General’s Chambers today indicated to the Kuala Lumpur High Court that they will be making a preliminary objection to another judicial review application filed by six voters from the Segamat parliamentary constituency.
The voters are seeking to quash the inclusion of 102 electors from a new army camp in the constituency into the supplementary electoral roll for the third quarter of 2017.
The six voters - Abu Bakar Ibrahim, Azmi Othman, Gangadharam Arumugam, Johari Ahmad, Khairudin Sagap and Mohd Rizal Mohd Sohot - named the Election Commission and EC registrar Shafie Taib as respondents.
Besides seeking to quash the entry of the 102 voters, they are also seeking a declaration that the entry of these voters is unconstitutional.
They are also seeking a stay of the certification and gazetting of the 102 disputed names.
Lawyers for the six - N Surendran and Latheefa Koya - said today that the AG's Chambers represented by senior federal counsel Suzana Atan and Shamsul Bolhassan for the EC had told Justice Kamaludin Mohd Said that they will be objecting.
Last week, the AG's Chambers had also protested a judicial review application by 48 other Segamat voters mainly from the DAP and Parti Amanah Negara who were protesting the inclusion of 949 names comprising army voters and their spouses at the same constituency.
Suzana and Shamsul said they made the preliminary objection on the grounds the voters had not exhausted their legal avenue at the EC's local inquiry where they can appeal to the adjudicating officer.
Surendran told reporters that Suzana and Shamsul would be using the same grounds for their preliminary objection against the six voters.
Yesterday, the 48 voters from the DAP and Amanah were granted leave by KL High Court judge Justice Azizah Nawawi to have their judicial review challenge on the entry of the 949 voters be heard on its merits.- Mkini
