The case management for murdered bully victim T Nhaveen has been postponed yet again, to Feb 26, to enable the prosecution to file the application to transfer the case to the High Court in Penang.
Magistrate Mohamad Amin Shahul Hamid fixed the date, while deputy public prosecutor Nurul Fatin Hussin appeared for the prosecution.
The lawyer holding a watching brief for Nhaveen's family, Baljit Singh, said the prosecution has explained to the court that all the documents related to the case are ready.
"We have obtained all the documentation for the trial, including the post-mortem report," Baljit told Malaysiakini.
"The public prosecutor has also apologised for the delay in obtaining the chemist’s report," Baljit added after the session at the magistrate’s court in George Town today.
"We are transferring the case to the High Court because it is a matter under Section 302 of the Penal Code, which involves murder," he added.
"The wheel of justice is turning, even though we would like it to be faster."
On Sept 28 last year, the case was postponed as Nhaveen's family was yet to obtain the post-mortem report.
RM1,000 paid for post-mortem report
The case was then fixed for Dec 6, and then put off to today as the post-mortem report was still not ready.
The family had on Aug 15 last year paid RM1,000 to the Penang General Hospital for the post-mortem report and has been urging the authorities to speed up on the report so that a full-blown trial can commence.
Four youths - J Ragesuthan, 18, S Gokulan, 18, and two juveniles, aged 16 and 17, claimed trial to the charge under Section 302, which carries the death sentence upon conviction.
Nhaveen, 18, was allegedly assaulted by several youths in Gelugor, Penang, while he was on his way back from work on June 9 last year.
His friend who was with him, T Previin, 19, escaped. Nhaveen succumbed to his injuries on June 15 at the Penang General Hospital.
Tears flowed during his funeral on June 16. The incident shocked the nation and was widely reported in the media, with various groups and politicians calling for an end to teen bullying and violence.- Mkini
