Employees given quarantine order must use sick leave, not annual leave

CORONAVIRUS | Employees who have been issued with a quarantine order due to Covid-19 cannot be forced to use their annual leave, said the Human Resources Ministry.
"Employees given a quarantine, observation or home surveillance order cannot be forced to use their annual leave for the quarantine period as annual leave is a workers' right," it said in a statement today.
It added that employers who refuse to provide paid sick leave would be committing an offence under Section 60F of the Employment Act 1955.
Noting that companies are facing stress due to Covid-19, the ministry also suggested alternatives to retrenchment.
This includes limiting overtime, reducing workdays or number of workers in a week and reducing work hours.
It said companies also can initiate temporary lay-off while maintaining a "reasonable" salary or implementing salary cuts that are fair.
The ministry said companies that have no choice but to retrench their workers must follow the Labour Department guidelines and provide a 30-day notice to the department.
It added that employers who fail to comply can be fine up to RM10,000 per offence.
The ministry added it has set up an operations centre to record all retrenchment across peninsular Malaysia. Sabah and Sarawak have autonomy in managing their own labour affairs. - Mkini
