Court rejects Umno’s bid to stay hearing of SRC’s RM16mil suit

KUALA LUMPUR The High Court has dismissed a stay application by Umno to halt the hearing of a RM16 million lawsuit filed by SRC International Sdn Bhd and its two subsidiaries.

Lawyer Shahrul Fazli Kamarulzaman, who represented Umno, said judicial commissioner Arief Emran Arifin held that there were no special circumstances to grant the stay of the hearing pending the disposal of the party’s appeal at the Court of Appeal.

“The judge indicated that the trial of this suit could be heard in two years after interlocutory matters were disposed of,” he told reporters after an online proceeding.

The court also fixed May 9 for another case management.

Lawyer Nur Syafinaz Vani Abdullah appeared for SRC International, Gandingan Mentari Sdn Bhd and Jendela Pinggiran Sdn Bhd.

In November last year, the High Court dismissed Umno’s striking out application against the three plaintiffs.

The court also allowed the plaintiffs to amend their statement of claim against Umno.

Following the dismissal of the striking-out application, Umno filed for a stay of proceedings on Dec 9 pending its appeal to the Court of Appeal.

In its writ of summons, the plaintiffs claimed that Umno knew, or ought to have known, that the RM16 million monies belonged to SRC International and it had no basis to receive the money.

On May 10 last year, the finance ministry confirmed that 1MDB and its subsidiary SRC International had filed 22 civil suits to recover its assets of over RM96.6 billion, including RM300 million from various political parties. - FMT
