Judicial Commissioner Ratanah Devi Yusof Perumal ruled that the pair wilfully breached the clear terms of an ex-parte order and ad-interim order issued by the court.
“I find that despite the clear terms of the ex-parte and ad interim order, there was a clear breach of the terms of both court orders,” she said in her ruling on Sept 18.
The judge ordered them to pay the RM100,000 fine within 14 days of the judgment or face 21 days in prison in default.
Roger Chin represented SMM while Jontih and Tei were represented by Jul Hamri Jumhani and Chong Kian Ming, respectively.
SMM sued Jontih and Tei in January 2025, accusing them of fraud, breach of fiduciary duty, tampering with official documents, and conspiracy to injure.
Tei is also standing trial on multiple corruption charges involving two former assemblymen and a former senior political secretary to the prime minister.
In August last year, Tei sued SMM for allegedly falsely linking him to a conspiracy to damage the company’s reputation and that of its current CEO, as well as document tampering.
On Aug 28 this year, the Kota Kinabalu sessions court dismissed Tei’s defamation suit, ruling that the controversial businessman had failed to establish the defamatory elements in his claim. - FMT
