The Registrar of Societies (ROS) has told the DAP central executive committee not to make decisions on behalf of the party because its status is yet to be recognised.
In a Dec 6 letter signed by Mohammad Razin Abdullah to party secretary-general Lim Guan Eng, ROS tells the party to submit four documents as it deemed the re-election report submitted to be too brief (terlalu ringkas).
It also said the reports submitted to ROS were lacking in the details it needed.
“Considering of the complaints brought up by DAP members and branches to date, ROS still can’t recognise (the fact) that re-election was conducted based on the letter issued on July 30,” the ROS letter says.

The four documents that it now wants are details of all 2,576 central delegates, details of those who voted in the re-election, details of all the branches and annual report that includes the new line-up.
“With this, you are advised to bring this to the attention of CEC members, whose status has yet to be recognised, to refrain from making any decision on behalf of DAP, until ROS has completed its probe on the implementation of the DAP congress,” the letter says.
The letter was revealed at an urgent press conference called today by party organising secretary Anthony Loke, who criticised the instruction or "advice" as ridiculous and a conspiracy by the political masters of ROS.
DAP will submit documents, but...
Loke said DAP would submit the four documents demanded but would not oblige with the order that the CEC cannot act on behalf of the party because it is yet to be recognised.
"DAP cannot and will not accept this particular so-called directive because it is ridiculous. The party can't operate in a vacuum.
"ROS only asked us to carry out the re-election, with a simple letter dated July 30, which we complied with on Sept 29.
“As far as we are concerned, after we completed our special congress with the new CEC line-up elected, the new office bearers can operate and decide on the affairs of the party,” Loke (left) said, adding that if ROS took a few months or even years to decide, it would mean the DAP could not function during this period.
"ROS said we can't make any decision. Does that mean the new office bearers cannot even occupy the DAP headquarters, that the treasurer cannot sign cheques to pay the salaries of the staff?" he asked.
The party would consider challenging the ROS order in court should need arise, or if ROS refuses to recognise the decisions made by the party, Loke said.
English daily The Star today reported ROS deputy director-general Alias Mamat as saying DAP should not use delaying tactics if it wants to resolve the dispute with its disgruntled members as soon as possible, and he urged DAP to submit the four reports soon.
The statement by Alias was very uncalled for, Loke said, as the party only received the first official ROS letter, dated Dec 6, one month after the party submitted its annual report and the new line-up.
Two weeks after DAP submitted the reports, Malay daily Utusan Malaysia quoted a former DAP member and former Taman Sungai Pelek branch chairman, Tan Tuan Tat, as saying that ROS has claimed the reports submitted by DAP were incomplete, Loke added.
