The resignation of three Terengganu assemblypersons, including former menteri besar Ahmad Said that resulted in BN becoming a minority government, calls for the state legislative assembly be dissolved, a constitutional expert says.
Abdul Aziz Bari said constitutionally, BN cannot continue ruling the state and that newly-minted Menteri Besar Ahmad Razif Abdul Rahman must tender his resignation.
“As far as the sultan is concerned, he should either appoint the majority or dissolve the House. Given the uncertainty, the better option to my mind is to dissolve the state legislative assembly,” Aziz told Malaysiakini.
"Another reason why the sultan ought to be dissolving the House to pave way for a state election is that Ahmad Said was basically his (the sultan’s) personal choice in 2008.
"As it happened, it was clear Ahmad Said failed to stabilise the state. In a way, the choice made by the sultan has not been right.
"Thus the sultan should not repeat the 'mistake'. Given this, the safer option is for him to let the people of Terengganu decide,” Aziz added.
He was commenting on theabrupt resignations of Ahmad Said (Kijal assemblyperson) and Ghazali Taib (Ajil) from Umno yesterday to become Independents in the Terengganu assembly.
The duo were today joined by Bukit Besi assemblyperson Roslee Daud, who also resigned from Umno to become the third Independent.
Let the people decide
By dissolving the Terengganu legislative assembly, Aziz said, Sultan Mizan Zainal Abidin is signaling to his subjects to give him the right government.
He added that Terengganu has been unstable since 2008 and the sultan should end this by giving the people a chance to decide who they want to govern the state
“Appointing a government from the existing state legislative assembly, as the sultan has done before, proved not to be the better option as the government becomes a lame duck,” said Aziz, who was a Pakatan candidate in last year's general election.
Yesterday, Ahmad Said was coerced to tender his resignation as menteri besar, paving the way for Ahmad Razif to become the 14th menteri besar, having taken his oath of office last night.
BN initially had 17 state representatives compared with 15 for the Pakatan Rakyat.
