Military Court amends charges on Major Zaidi


The Military Court has today amended five of the seven charges made against Major Zaidi Ahmad, who is on trial for reporting to the press about indelible ink used in the 13th general election last May.

Following protests from his defence lawyers at a court hearing in April, the army has now decided that the pilot has violated a different section of the army law altogether.

Under five of the charges, Major Zaidi is now said to have broken  Section 51 of the Armed Forces Act 1972, amended from Section 50 (2) of the Armed Forces Act 1972. Out of these five, two charges were also corrected for “location” errors.

Two amended charges now spell out that the Major Zaidi has disobeyed the orders of his superiors near a mini-mosque (surau).

The charges were amended to read that Zaidi broke a 1961 army law pertaining to discipline and security matters in “the vicinity of the mosque of the Kepala Batas police station” rather than just “the vicinity of the Kepala Batas police station”.

The Royal Malaysian Air Force (RMAF) pilot had pleaded not guilty to the charges of giving media statements on the impermanent nature of the indelible ink used in last year’s GE13, after voting early on May 1, and also for sending two short text messages deemed political and seditious in nature.

The trial will resume tomorrow, giving time to the prosecution to call its witnesses.

The prosecution team comprised of Major Ahmad Sanusi Ali, Captain Fadzil Nor Alias, and Captain Ross Anuar Aripin.

The case was heard before Colonel Saadon Hasnan, acting head of the court along with five members of the court, which consisted of Lieutenant Colonel Zainurin Mohd Dom, Major Khuzairi Mohd Arshad, Major Khairul Nizam Taib, Major S Nadzeer Sallehuddin and Major Noor Azman Ahmad.

Major Zaidi was represented by defence counsel Hanipa Maidin.
