ON THE CUSP OF EXTINCTION: 'MIC not your personal property' - Samy's son tells Palanivel
I have just read Datuk Seri G. Palanivel's press statement and would like address some fallacies in his press statement.
1. That RoS didn't seek any feedback.
1.1 That is wrong and inaccurate as RoS had sought and obtained statements from all Election Committee members, former SG, current information chief amongst others.
1.2 If there was no feedback or knowledge, how is it then that Palanivel announced on December 2, 2014 should the RoS direct for reelection that MIC would follow? Shows he had knowledge of the investigation.
1.3 There were also various articles both on print, free-to-air and online media on the RoS visit to MIC and investigations.
2. By seeking time, the party has submitted to the RoS findings. Either you seek time to comply or challenge it. You cannot do both.
3. Is Palanivel protecting MIC's position or merely delaying matters and leaving RoS with no option but to de-register?
4. Who are the lawyers? Need to know who these lawyers are as they have acted without lawful authority from congress, as the president needs mandate to appoint these lawyers.
4.1 If the lawyers were members of the election committee, then since they have given sworn statements to RoS, they cannot act.
4.2 Mr Chandra who gave his opinion at the December 18, 2014 general meeting. Then he is of conflict since he is now a material witness to a police investigation as the former secretary-general has lodged a report on incidents where he is a material witness.
4.3. Mandate must be obtained from the CWC. By him not seeking mandate from the CWC for the period of 2013 to 2015, he has also confirmed to our stand this CWC for 2013 to 2016 is null and void as a result of the December 5, 2014 letter from RoS.
4.4. If I am seeking legal opinion for my own consumption or opinion, then I can appoint my own lawyers but not to represent the party. I need mandate from congress.
4.5 In our case the CWC is null & void, but on December 18, 2014 at the general committee meeting as declared by the president, a mandate was given by the general committee to the president to form a committee to find a remedy with regards to the RoS directive. It will be made up of the president, deputy president, Tan Sri Nijhar and 5 members from those who lodged a report with the RoS and 5 members from the winning team for the 2013 to 2016 term.
Further, another mandate was also given to the president and deputy president to meet RoS to seek clarification. These decisions made at the general meeting were disclosed to the press on December 18, 2014 by the president himself.
Hence in my opinion, it is this committee that should appoint or give the president mandate to appoint a lawyer.
Palanivel
Reading through his statement, one can clearly see that he never implemented or followed the decisions. Instead of calling upon the RoS with the deputy president as per the general committee mandate, he decided to ignore the directive and address RoS on his own – a mandate which he does not have.
So now Palanivel, I seek your answers to my concerns and divulge the RoS reply on New Year’s eve. The fact that RoS replied on the eve despite the festive holidays shows how serious they are in enforcing the law.
MIC is not his private property. This party has in excess of 600,000 members and represents the Indian community in government. The members and the community have the right to know the information on RoS.
From his statement, it's clear he is in pursuit of a legal confrontation. I put it to Palanivel that this is not just another civil suit. In this case, we the MIC, being a member of the BN government and represented by unlawfully appointed lawyers, are taking on a government statutory body, which is captained by the prime minister.
In his statement, Palanivel gave his assurance that he will not allow the party to be de-registered. Well, he also gave assurances that the election was free and fair, democratically conducted with no foul play. Well, the RoS letter proved him wrong. To make matters worse, he was chairman of the Election Commission.
The best advice for Palanivel is for him to give us assurances that he will start to fulfil his own words. – TMI
