King should ask for Federal Court’s opinion, says Kit Siang

 

Under the constitution, the Yang di-Pertuan Agong may refer any question to the Federal Court for a constitutional opinion.

PETALING JAYA: A senior MP has suggested that the Yang di-Pertuan Agong obtain the opinion of the Federal Court on whether the constitution allows for a proclamation of a state of emergency and suspension of Parliament to enable the prime minister to resolve his political problems.

The suggestion came from DAP adviser Lim Kit Siang, who is Iskandar Puteri MP. However, he did not elaborate on the matter.

Article 130 of the Federal Constitution states that the King may refer any question to the Federal Court for an opinion as to the effect of any provision of the constitution which has arisen or appears likely to arise.

Under the constitution, the King may declare a state of emergency if he is satisfied “that a grave emergency exists whereby the security, or the economic life, or public order in the Federation or any part thereof is threatened”.

Lim’s question was whether the state of emergency could be declared for a prime minister to resolve his political problems.

He also questioned whether the Cabinet had presented to the King the option of a proclamation of Emergency, without suspension of Parliament.

There has been widespread speculation about a state of emergency, with opposition politicians accusing Prime Minister Muhyiddin Yassin of seeking a declaration of an emergency and the suspension of Parliament, in order to remain in power.

However, no details about the proposed state of emergency have been announced.

Earlier today, the Comptroller of the Royal Household Ahmad Fadil Shamsuddin said the King will meet Malay rulers on the proposals mooted by Muhyiddin at an audience with the King in Kuantan, Pahang, yesterday.
