Former premier Najib Abdul Razak’s son Mohd Nazifuddin Najib has filed an appeal against a court greenlight for summary judgment of a RM37.6 million tax suit against him (Nazifuddin).
Nazifuddin’s counsel Muhammad Farhan Muhammad Shafee confirmed that the appeal was filed at the Court of Appeal on July 20 this year.
“The appeal was filed after the High Court decision, namely on July 20,” Farhan told Malaysiakini this afternoon.
On July 6, the Kuala Lumpur High Court allowed the Inland Revenue Board’s (IRB) bid for summary judgment in the tax suit against Nazifuddin.
Under the law, summary judgment is where a party applies for the court to decide on a matter summarily without going for a full trial.
On Aug 8 last year, Malaysiakini reported that the IRB filed a suit to recover RM37.6 million in alleged unpaid taxes from Nazifuddin for assessment from 2011 to 2017.
Aside from Nazifuddin, his father and brother, Najib and Mohamad Nizar Najib, have also filed appeals against the IRB’s successful bid for summary judgment in tax suits against the duo.
On Monday (Oct 26), it was reported that Najib filed his appeal against the Kuala Lumpur High Court verdict to allow the IRB’s bid for summary judgment in a RM1.69 billion tax suit against the former premier.
Yesterday (Oct 27), news portal The Edge Markets reported that Nizar filed an appeal against the Shah Alam High Court decision allowing the IRB’s application for summary judgment in a RM13.16 million tax suit against him.
Additionally, it was reported on Monday that the IRB has filed an appeal against the Shah Alam High Court decision to dismiss the board’s application for summary judgment in a RM10.3 million tax suit against Nooryana Najwa Najib, the daughter of Najib.
Meanwhile, in relation to the Court of Appeal case management of the tax suit-related appeals of Nazifuddin, Nizar, and Najib, Farhan said that they were all fixed for Dec 16. - Mkini
