Mandiri executive director Amir Hariri Abd Hadi has been acquitted of his criminal charges under Section 9(5) of the Peaceful Assembly Act (PAA) for allegedly failing to notify authorities of organising a rally in 2022.
The decision was delivered by magistrate Farah Nabihah Muhamad Dan this morning after deputy public prosecutor Anis Wahidah Mohamad informed the court that the prosecution has been instructed to retract the charges on Aug 5.
Anis also asked the magistrate to grant a discharge not amounting to an acquittal (DNAA) under Section 173(g) of the Criminal Procedure Code.
However, Amir’s lawyer Rajsurian Pillai rebutted that a DNAA would cause the charge to hang over the accused’s head, risking him of another prosecution in the future. As such, he requested a full acquittal for Amir.
Amir was charged in 2022 under Article 9(5) of the PAA for allegedly failing to notify the authorities of the #ManaKapalLCS rally five days before it was held on Aug 14, the same year.
He then obtained the High Court’s permission to challenge the provision at the Federal Court last year, to which the highest court declared the provision unconstitutional and no longer valid in July this year. - Mkini
