Tycoon ‘brave’ to pay RM27mil for land he didn’t own yet, says MACC officer

Court heard that Ewe Swee Kheng paid businessman Zarul Ahmad Zulkifli before Ewein Zenith formally secured Lot 702, based on an alleged promise by Lim Guan Eng.

KUALA LUMPUR:
The investigating officer tasked with probing the Penang undersea tunnel project told the sessions court that it was “strange” for a property tycoon to pay millions to a fellow businessman to secure state prime land before obtaining any official confirmation.

Zulhilmi Halim, from the Malaysian Anti-Corruption Commission (MACC), said the late Ewe Swee Kheng was “brave” to pay businessman Zarul Ahmad Zulkifli around RM27 million before Ewe’s company (Ewein Zenith Sdn Bhd) secured the ownership of Lot 702.

“It is ‘nonsensical’ to pay millions to Zarul’s company for a plot of land that he (Zarul) has yet to receive (the ownership).

“Datuk Ewe told us (during the recording of statement) that the accused (Lim Guan Eng) promised him a plot of land through Zarul.

“This showed that there was an ‘agreement’ between the accused, Zarul and Datuk Ewe,” he added.

Lim is accused of using his position as chief minister to solicit a 10% share of profits from the undersea tunnel project, as well as receiving RM3.3 million in bribes from Zarul.

He also faces two charges of dishonestly misappropriating state land worth RM208.7 million.

Zulhilmi also told the court that the initial investigation papers against Lim – opened in 2018 – were marked “no further action” as there was insufficient evidence.

“(Contents of) some witnesses’ statements only touched briefly on the facts.

“(When I took over the case in 2020), I focussed on financial statements and the payments made from Ewe’s company to Zarul’s firm,” he said.

Zulhilmi said his investigation showed that Zarul had “no intention” to build the undersea tunnel as well as three roads.

“It was the accused who took the first steps and informed the exco meeting about a ‘company wanting to build an undersea tunnel’,” he added. - FMT
