Court rejects bid to postpone temple relocation

SHAH ALAM: The Shah Alam High Court has rejected a bid to postpone the takeover of the land housing the Sri Maha Mariamman temple in Seafield, Subang Jaya, which has been the scene of violent clashes following a mob attack by an unknown group on Monday.
The decision by judge M Gunalan means the process to relocate the temple as agreed between land owner One City Development, the Selangor government and two groups representing the temple would go ahead.
The application to postpone the relocation was filed by three individuals – S Thangarajoo, M Mohanakrishnan and S Nagarajah.
Nagarajah, who filed the suit last month, had previously failed to oust temple manager K Chellapa in a separate suit. Chellapa has said he is abiding by a consent judgment to relocate the temple.
The trio’s lawyer S Mogan said despite the decision today, his clients would go ahead with a lawsuit against the developer, the Selangor state government and the temple committee, who are part of the consent judgment in 2014.

“The court in short said that the three individuals who sought the stay order failed to show the reasons to the court on why the eviction must not go on,” Mogan told reporters.
Meanwhile, Save Sri Maha Mariamman Temple task force leader VK Regu, who was in court for another case related to the temple, said judge Gunalan has discharged himself from listening the second suit by him and others.
“I was informed that the judge did not want to be prejudice towards my case in seeking an injunction on the eviction because he is hearing another case on the devotees,” said Regu.
The temple had been slated for relocation on Nov 22, but in an about-turn, Nagaraju insisted that the temple should remain at its present location instead of being relocated some 3km away.
Under the consent judgment in 2014, One City agreed to donate RM1.5 million for the construction of a new temple on one of two plots of land given by the company.
After the temple gave up the rights to one of the two plots of land, One City gave it another RM1 million in compensation.
