Ex-MB: Just because of spat, Dr M can't say Johor constitution nullified



Former Johor menteri besar Khaled Nordin has rebuked Prime Minister Dr Mahathir Mohamad for claiming that the state's constitution had been nullified.
"Just because he is at loggerheads with the Johor sultan, he cannot say the state constitution was nullified.
"Malaysia is a federation, not a unitary nation. The attorney-general should advise Mahathir on this," Khaled told Malaysiakini.
Mahathir, in a blog post today, claimed that the state constitutions of Johor and Terengganu had been nullified when the Federation of Malaya was formed.
Johor's constitution was established in 1895, while Terengganu's constitution was drawn up in 1911.
The constitutions of all the Malayan states are the basis for the formation of their respective state legislative assemblies, as well as the guiding law on how the state government should be formed.
Mahathir's remarks come after disagreements with the Johor palace over who decides on the appointments of the menteri besar and members of the state executive council.
Sultan Ibrahim Sultan Iskandar insists that the Johor constitution gives him authority over such matters.
The prime minister, however, said the power lies with the political party or parties that win an election.
In his blog post today, Mahathir said if a prime minister or menteri besar is endorsed by a constitutional monarch against the winning party's wishes, a vote of no-confidence can be moved in the state legislative assembly. - Mkini
