Lawyer files police report against ex-AG over release of LTTE 12

Lawyer Mohd Khairul Azam Abdul Aziz has filed a police report against former attorney-general Tommy Thomas over the latter’s decision to discontinue LTTE-linked terrorism proceedings against 12 individuals.
Khairul (above) lodged the report at the Sentul police station on Feb 28.
On Feb 21, Thomas exercised his constitutional power as then attorney-general to release the 12 individuals detained over alleged support of the defunct Sri Lanka-based militant organisation. 
According to the report, Khairul urged the police to arrest Thomas as part of an investigation into alleged abuse of power by discontinuing the LTTE terrorism cases.  
The Putra vice-president also urged the police to probe Thomas and other lawyers such as Ramkarpal Singh over an alleged conspiracy linked to the discontinuance of the LTTE terrorism proceedings.
“I am worried that following his resignation as attorney-general, Thomas would escape overseas and I urge the immigration authorities to impound (menahan) Thomas’ passport,” he said.
Khairul added that Thomas’ (photo) alleged abuse of power in discontinuing the LTTE terrorism proceedings had denigrated (memperlekehkan) the duty of the police to investigate the suspects.

The lawyer also urged for the re-arrest of the 12 individuals previously detained over alleged support of the defunct militant group, among others.
When contacted by Malaysiakini today, Khairul said that his related complaint came up for mention before the Kuala Lumpur Magistrate’s Court around 2.30pm this afternoon.
He said the mention is over his application to refer his complaint to be examined under Section 108 of the Criminal Procedure Code.
Khairul said he is applying for the magistrate to hear out his complaint related to the police report.
“If the magistrate is satisfied with the police report in relation to there being a criminal element, the magistrate can then issue an order (for the police) to investigate (the allegation of abuse of power by Thomas in relation to the discontinuance of the LTTE terrorism cases).
“Today was case management where the magistrate (M Saravanan) directed us to give related documents to the Attorney-General’s Chambers.
“As the courts are set to close (tomorrow until March 31), the magistrate could not fix a date (to hear the complaint). After March 31, the court will be able to hear the case,” Khairul said.
It was reported that following Prime Minister Muhyiddin Yassin’s announcement yesterday of movement control order to prevent the further spread of the Covid-19 pandemic in Malaysia, all courts nationwide would postpone trials and physical face-to-face case management from tomorrow until March 31.
