Bar Council to probe identity of SD2 mystery lawyer



The Bar Council said it is investigating to establish the identity of the mystery lawyer alleged to have drafted private investigator P Balasubramaniam’s second statutory declaration (SD).

“The Bar Council reiterates that we are investigating the allegations made by Deepak Jaikishan concerning the conduct of the lawyers involved in drafting the second statutory declaration of Balasubramaniam Perumal.

“As with any other issue involving the potential misconduct of a member of the Bar, the Bar Council will make all necessary enquiries - in this instance, to ascertain the identity of the lawyers concerned and whether they have committed any professional misconduct,” said Bar president Lim Chee Wee.

NONELim (left), in a statement today, said the council will follow due process in the matter “without fear or favour, and in accordance with due process, regardless of the personalities or circumstances” but urged all parties not to be hasty.
He urged any persons with evidence of misconduct with the matter to lodge a complaint with the Advocates and Solicitors Disciplinary Board, which he said is independent of the Bar Council. 

“This is undoubtedly a serious matter. It cannot be resolved on an indulgence of surmise, conjecture or deductions (simple or otherwise).  

“To do so would be to sacrifice due process (including natural justice) at the altar of expediency or convenience. This would ultimately compromise the proper determination of the matter,” he said. 

On Dec 19, lawyer and activist Haris Ibrahim had lodged complaints against a lawyer, whom he did not name, accusing the latter ofmisconduct for allegedly preparing Balasubramaniam’s SD2. 

Today, he challenged Cecil Abraham to sue him to clear his name, over this matter, if he felt the Bar Council is taking too long to do so.

Malaysiakini’s attempts to contact Cecil for comments since last month have gone unanswered.
