"Ditolak (rejected)." That was possibly the briefest court judgment ever, and it was given by High Court Judge Vazeer Alam Mydin Meera here today.
The judge delivered the verdict in dismissing the application by web company Electric Angels MSC Sdn Bhd to hold Proton Holdings Bhd in contempt of a Court of Appeal order directing the national carmaker to provide the plaintiff with details of car buyers over a certain period.
Speaking outside the court after the decision, Electric Angels counsel Datuk Rabinder Singh expressed shock, saying no grounds were given as to why the application was thrown out, "whether it's technical or on merits".
"This is the fourth hearing. At no point in time did we receive any indication it would be dismissed," said Rabinder, adding that he had not been asked to present oral submissions to clarify any points.
"We will be applying for a written judgment and appealing to the Court of Appeal by tomorrow for sure," he said.
On Oct 11 last year, a three-member Court of Appeal bench of Justices unanimously found merit in the application by Electric Angels to obtain buyer details from Proton.
The bench had ordered Proton to supply Electric Angels with the details of 267,000 car buyers it had requested to assess who had bought cars through the Proton website.
Electric Angels, the developer and operator of the Proton Live system, which ran on Proton's website from June 2006 to June 2009, as the sole agent was to get a RM750 commission for every car bought through the Proton website.
