'Police can hold suspects for 72 days with court order'


The Prevention of Crime Act 1959 (Amended 1983) allows the police to detain suspects for 72 days to facilitate investigations, according to Inspector-General of Police Khalid Abu Bakar.

NONEHowever, the police would still have to apply to the court for a detention order, he said in Penang today.
"Whatever violation under the Prevention of Crime Act will be considered serious, and those involved can be punished heavily," he said.

Khalid (right) said the police have arrested 200 suspects nationwide under the Act under the ongoing crackdown on crime.
According to the Act, after arresting a suspect, the police need to produce him or her to the magistrate where a 14-day remand would be granted if the court is satisfied with the grounds of investigation.

If the police need to further its probe, the deputy public prosecutor must write to the magistrate and can be granted another 28 days if the court is satisfied there is evidence for an inquiry.

Following that, another 28 days can be requested if the magistrate is satisfied there is “unreasonable delay” in the inquiry.

NONEAsked if any of the suspects were ex-Emergency Ordinance detainees, he said he does not have the information yet.

"We will let you know later," he said.
Khalid was in Penang to announce the success of the state police with the cooperation of Bukit Aman to gun down five men who are believed to be related to the spate of shootings in the state.

“We believe we managed to solve 10 cases of murders in Penang (seven), Kedah (two) and Negri Sembilan (one).

“These include two attempted murders in Penang and another two in Kedah,” he added.

Khalid said at about 4.30am, police went to the apartment in Sungai Nibong where the five men, between 21-30 years, were holed up.
'Suspects opened fire'

He added that upon the police’s arrival, the suspects opened fired and in “self-defence” the force fired back.

However, when asked how many shots were fired back, Khalid said “a few”.

Khalid said the police then managed to seize three ammunition clips and 15 mobile phones from the scene.

“We never kept quiet. When these cases happen, we set up a taskforce to probe the incidents,” he said.

“Since Saturday, we set up operations centres and targetted operations to probe the suspects, secret societies’ nests and suspected drug traffickers,” he added.

“Since Saturday, we have had roadblocks to check suspicious vehicles and places frequented by the suspects,” he stressed.
