Sex bloggers challenge validity of charge
Sex bloggers Alvin Tan and Vivian Lee had filed an application with the Kuala Lumpur High Court two days ago to challenge the validity and constitutionality of one of the three charges against them, the Sessions Court heard today.
Tan's counsel Chong Joo Tian told the court that the application was to challenge the second charge under Section 298A of the Penal Code.
The couple was charged for a posting on their "Alvin and Vivian - Alvivi" Facebook site of a photograph of themselves eating bak kut teh with the greeting "Selamat Berbuka Puasa with bak kut teh... fragrant, delicious and appetising", together with the "halal" logo.
Chong said the High Court had yet to decide the on the date of judgment with regard to the application.
As a result, Sessions Court Judge Dazuki Ali fixed Sept 19 for mention pending the High Court decision.
The Sessions Court was supposed to set a date for trial today.
The couple refused to take questions from reporters when leaving the courthouse.
