Court dismisses suit by late Navy cadet Soosaimanicckam's family

The family of Royal Malaysian Navy (RMN) cadet officer J Soosaimanicckam, who died during training six years ago, today failed in their lawsuit against the Malaysian Armed Forces Council, the defence minister, the Malaysian government, and 12 others.

Lawyer Latheefa Koya, representing Soosaimanicckam’s father, S Joseph, when contacted by Bernama, said that Sessions Court Judge Idah Ismail struck out the suit with costs of RM10,000.

She said the decision was delivered via email today.

Federal counsel Abdul Hakim Abdul Karim represented all the defendants.

Joseph filed the suit on May 19, 2021, alleging negligence on the part of the defendants for failing to provide emergency treatment when his son collapsed on the day of the incident, and for monitoring his well-being and health during training sessions.

He also named 11 individuals including RMN officers and the RMN commander as defendants.

He sought general damages, aggravated damages, exemplary damages, and other relief deemed appropriate by the court.

On July 29 this year, the High Court ruled that Soosaimanicckam’s death was a homicide and that the cause of death was pulmonary oedema due to leptospirosis.

The court also ruled that his untimely death was a direct consequence of RMN officers in charge of his training and that the officers denied the deceased’s request to seek medical treatment.
